Florida-Specific Consumer Rights
Under the Florida Credit Service Organizations Act, Chapter 817, Part III, Florida Statutes (§§817.7001–817.7016), Florida consumers have the following rights when working with a credit service organization such as Shield Credit Professionals:
- The right to receive a written Consumer Credit File Rights statement and information statement before signing any contract, as required by Fla. Stat. §817.7006.
- The right to a written contract that includes the full terms of service, total cost, estimated completion date, and your three-day right of cancellation.
- The right to cancel any contract with a credit service organization, without penalty or obligation, within three business days of signing.
- The right to be protected by a $10,000 surety bond on file with the Florida Department of Agriculture and Consumer Services. Any consumer damaged by a violation of the Florida Credit Service Organizations Act, or by a breach of contract by the credit service organization, may bring an action against the surety bond.
- The right to file a complaint with the Florida Department of Agriculture and Consumer Services, 2005 Apalachee Pkwy, Tallahassee, FL 32399, 1-800-HELP-FLA (1-800-435-7352), FDACS.gov.
- The right not to be charged for services that have not yet been performed.
